Scottish Ministers have approved both of the Burntisland Harbour Access Trust (BHAT) applications.
We, the community, now have first refusal on both the Forth Ports and Network Rail areas of the East Dock shown edged red and yellow on the plan. The current owners may appeal the decisions but the Ministers’ letters make it clear that we have made a convincing case. We have no doubt that the decision was made on its merits, but we are grateful for the support and interest that we have received from our elected members at every level of government and from all our supporters.
Our aim has been and remains retaining community access to the East Dock – breakwater, western peninsula (Shanks Pier) and the north quay. After the frustrations of failing to achieve it by negotiation we sought ways to purchase the East Dock. We now have first refusal; this blocks the sale (but not a lease) of the East Dock to any other party without first offering it to us. We may also investigate acquiring the derelict land by compulsory purchase.
We’re now considering the next moves. In the meantime, as potential landlords, we will engage with the East Dock stakeholders to see how we might meet their aspirations. Armed with this information we will seek a wider community view on how to proceed. We have a long way to go but these early steps are encouraging.
